Official Customer Support Satisfaction Contest Rules
THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING IN UNITED STATES AND
SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.
DO NOT PROCEED ON THIS SITE IF YOU ARE NOT LOCATED IN THE UNITED STATES.
1. Entrants must be 18 years or older at the time of entry. Employees,
officers, and directors of Moldflow Corporation (the “Sponsor”),
and their subsidiaries and affiliated companies, and their immediate
families and those living in their households, are not eligible. Non-maintenance
Customers, Educational Customers, Distributors, and Resellers are
not eligible. Void where prohibited or restricted.
2. To enter the Contest, fill out and submit a customer satisfaction
survey on-line at http://www.surveymonkey.com/s.asp?u=414361422182.
The registration instructions will request you to submit your name,
address, telephone number, and e-mail address (if you have one).
The Contest begins at 12:01 a.m. E.T. on the first day of each month
and ends at 11:59 p.m. E.T. on the last day of each month. Only one
(1) entry per person is permitted regardless of the number of surveys
submitted. Entries for each month will be discarded after each drawing.
An entry must be submitted each month to be eligible for prize. Winners
are limited to one (1) prize per year from when prize was awarded.
3. A winner will be determined by a random drawing conducted by a
Moldflow Corporation representative by the second Friday of the following
month, and the winner will be announced on the same day. Winner will
be notified by e-mail or by phone on or about the drawing date. Winner
will have fourteen (14) days from notification to accept the prize
by e-mail or by phone. The Sponsors and their officers, directors,
and agents shall not be liable for unsuccessful efforts to notify
a winner. Odds of winning depend upon the number of eligible entries
received.
4. One winner will be selected by the drawing, and that winner will
receive the prize selected for that month. No substitution or transfer
of prizes or cash equivalent is permitted. The Sponsors reserve the
sole right to substitute a prize of equal or greater value.
5. The Sponsors and their officers, directors, and agents shall not
be liable for (a) late, lost, damaged, incomplete, illegible, unintelligible,
or postage-due entries; (b) telephone, electronic, program, network,
Internet, or computer failures of any kind; or (c) failed, incomplete,
garbled, unintelligible, or delayed computer messages. If the administration
or integrity of the Contest is compromised or corrupted at any time,
the Sponsors reserve the right to modify, suspend or cancel the Contest.
The Sponsors and their officers, directors, and agents shall not be
liable for any injury or damage to an entrant's or any other person's
computer related to or resulting from entering the Contest. By entering
the Contest, entrants release and hold the Sponsors and their officers,
directors, employees, representatives, partners, and agents harmless
from any and all damages, claims, and liabilities of any kind in connection
with the Contest or resulting from acceptance, possession, or use
of any prize (including, without limitation, claims, costs, injuries,
losses or damages related to personal injuries, death, damage to,
loss or destruction of property, rights of publicity or privacy, defamation,
or portrayal in a false light).
6. By entering the contest, entrant also agrees that (1) any and all
disputes, claims, and causes of action arising out of or in connection
with the contest, or any prizes awarded, shall be resolved individually
without resort to any form of class action; (2) any claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering the contest, but in no event
attorney's fees; and (3) under no circumstances will any entrant be
permitted to obtain any award for, and entrant hereby waives all rights
to claim punitive, incidental, or consequential damages and any and
all rights to have damages multiplied or otherwise increased and any
other damages, other than damages for actual out-of-pocket expenses.
7. By registering to enter the Contest, entrants affirm that they
have read and accepted these official Contest rules. The laws of the
Commonwealth of Massachusetts, without regard to its rules and principles
of conflicts of laws , apply to and govern this Contest, and any claims
must be raised and resolved in Massachusetts . The foregoing includes
all issues and questions concerning the construction, validity, interpretation,
and enforceability of these Official Contest Rules, and the rights
and obligations of any contestant and the Sponsors. The invalidity
or unenforceability of any provision of these rules shall not affect
the invalidity or unenforceability of any other provision. In the
event that any such provision is determined to be invalid or otherwise
unenforceable, these rules shall be construed in accordance with their
terms as if the invalid or unenforceable provision was not contained
therein.
10. The Customer Satisfaction contest is sponsored by Moldflow Corporation.
Decisions regarding the selection of winners and all other aspects
of the contest shall be final and binding in all respects. Moldflow
Corporation will not be responsible for typographical, printing or
other inadvertent errors in these Official Contest Rules or in other
